402. Hit and Run (M/F)

Any person(s) while operating a motor vehicle, collides with a pedestrian or motor vehicle, then proceeds to drive away with intent to avoid consequences. May be combined with Manslaughter if collision resulted in deaths.

 

Shall be liable under a Class A (5), Class B (4), or Class C offense only, and shall receive a minimum of 12 Hours, along with a 3 Day license suspension and an 2 Day impounding of their vehicle. Sentencing Enhancements are allowed for this charge.

 

Note: As this charge can be tried as a misdemeanor or a felony, Class C shall apply to any incident where only property damage has occurred and thus will be charged as the misdemeanor, while Class A or B applies when there is injuries occurred and must be charged as a felony.
