1304. Duty Day Limits

  1. A driver that is operating a commercial motor vehicle must comply with the following duty day requirements:
    • A driver may be on duty no more than 14 hours per 24 hour period
      • A driver may drive for no more than 11 hours per 14 hour duty period
      • A driver must take a 30 minute break every 8 hours
    • A driver must rest (be off duty) for 10 continuous hours per 24 hour period
  2. A driver shall maintain a logbook which indicates the times at which the driver went on duty, off duty, was driving, and took his or her required breaks.
    • Drives will keep records for 7 days including the current day.

- Violations of Penal Code 1304 are an infraction. A commercial motor vehicle shall be put out of service for a violation of this section until such time that the violation is corrected, a legal driver takes possession of the vehicle, or a towing company moves the vehicle to private property that the vehicle is authorized to park on. A vehicle may not be put out of service for a violation that occurred prior to the last 10 hour rest period.
